Pond/Waterfall Update

May 28, 2008

As you are probably aware, we have activity occurring that is impacting our common areas. We are coordinating with the new developers on Shady Oaks (Terra/Hatcreek), the city and contractors to get issues resolved.

Shady Oaks Pond – the developers were approved by the city to tie-in to our retention pond for drainage. Due to unexpected April floods, we have had to lower the pond to dilute mud overflow and are in process of refilling. To fill this large amount without contaminated chlorinated water, we were waiting on city approval to have developers retention pond filled, filter their water to then fill into ours. We expect to this process to be completed in the next 10 days (along with restocking and clean-up). Although not mandated by the city, this is at the developers expense and they have agreed continue to pay for maintenance throughout this construction period. At some point, we will have to move our well equipment and/or electronics for our overfill pond to ensure proper continued operations. We are receiving bids on this. Our fountain is operational - we have turned off due to evaporation levels with high temperature.

Turnberry Lane – the city will be widening our gutter path and fixing our roadways to enable proper drainage directed to our back overfill pond. This will help with drainage issues onto Shady Oaks. This is at city expense and should occur over the summer months.

Peytonville – our well completely went out 2 weeks ago, therefore we have not had water for irrigation. Unfortunately, this is a deep well and the cost is considerable. The new developers are assisting us to speed up the process with the city and offering to trench a new city line and tie-into our landscaping. This will enable us to have a temporary solution until we can resolve. We are working on bids, insurance, and running models on what will be the best and most economical long term solution. In the interim, hope that it continues to rain.

Our waterfall is operational, but temporarily turned off as we work w/ contractors.

Gas/mineral update:

We’ll send out a separate email with details on progress.

We have girl scouts volunteers that place flags throughout our neighborhood on special holidays. One flag is missing from the Peytonville entrance. If you picked up due to weather blowing over, etc, please contact me to return to their owners.

Please ask with any questions.
